Sazerac Barrel Select 2024 Terms & Conditions

1. ELIGIBILITY: The 2024 Sazerac Barrel Select Selection Process (the “Selection Process”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are (a) age twenty one (21) or over in their jurisdiction of residence at the time of entry. To be eligible for The Drawing, a submitter must become a member on the “Sazerac Barrel Select” website on or before April 21^st , 2024, and list Buffalo Trace as their number one brand preference. Open to Individual persons only. Entries on behalf of corporations, LLC’s, or other organizations or groups are not permitted. Employees of Sazerac Company, Inc. and its affiliates and subsidiaries (“Sazerac”), wholesalers, retailers, or their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising agencies, and public relations agencies as well as members of their families and/or those living in the same household as such individuals are not eligible to participate. The Selection Process is (a) governed by these Terms and Conditions, (b) void where prohibited or restricted by law, and (c) subject to all applicable federal, state, and local laws and regulations. You must have access to the Internet and a valid email address in order to take part in the Selection Process. By submitting your information to Sazerac, you agree that you have read and consent to be bound by these Terms and Conditions, and Sazerac’s privacy policy, available here. Eligibility is conditioned on the acceptance of these Terms and Conditions and Sazerac’s privacy policy at time of entry. 

2. HOW TO SUBMIT: The Selection Process will take place on or about April 22^nd 2024. Based on the eligibility requirements set forth above and below, and upon completion of those requirements, each eligible submitter will be entered into the drawing, as determined by Sazerac in its sole discretion, for an opportunity to purchase the finished goods contents of a “Single Barrel” of one of the brands outlined in the table below, from a qualifying retailer of submitter’s choosing (the “Submission”). The specific contents and quantity of the goods may vary and will be determined by Sazerac in its sole discretion. Submitters are not obligated to purchase any products if they elect not to do so. Sazerac is not the party from whom any products will be purchased. The products must be arranged for purchase by submitter through a retail licensee of submitter’s choosing. The number of Sazerac Barrel Select points that a submitter has will equal the number of entries included into the drawing that submitter is determined to be eligible for. Sazerac Barrel Select account numbers will be used to identify those selected in the drawings. You can log-in to your Sazerac Barrel Select Account to find your account number. 

3. Use of any automated system to participate is prohibited and will result in disqualification. Sazerac is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected submission, all of which are void. Each individual selected may be required to show proof of being the authorized individual account holder of the account associated with their submission. Sazerac’s computer is the official Selection Process clock. 

4. SUBMISSION REQUIREMENTS: Each Submission must be complete and follow all requirements as set forth above and on the entry site. Any Submission that fails to meet the Submission requirements may be disqualified at any time in Sazerac’s sole discretion. Use of any macro, bot, script or other automated means to make or submit a submission is prohibited and will be grounds for disqualification in Sazerac’s sole discretion. Should you include personally identifiable information about yourself in your Submission, you acknowledge and agree that such information may be disclosed publicly, and you are solely responsible for any consequences thereof.

Sazerac reserves the right in its sole discretion to disqualify any Submission that it believes violates or potentially violates any of the foregoing requirements or otherwise fails to comply with any provision of these Terms and Conditions, or for any other reason. The decisions of the Sazerac on this and all matters pertaining to the Selection Process shall be final and binding. 

5. INTELLECTUAL PROPERTY: As a condition of entry, submitter agrees that Sazerac shall have the right to use, copy, modify and make available the Submission in connection with the operation, conduct, administration, and advertising and promotion of the Selection Process via communication to the public, including, but not limited to the right to make screenshots, animations, and video clips available to the public for promotional and publicity purposes. Furthermore, by participating in the Selection Process, each submitter grants (and agrees to confirm that grant in writing) to Sazerac and/or Sazerac’s designee the perpetual right to use his/her name, biographical information, photos and/or likeness, and statements for Selection Process, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered without notice, review or approval and without additional compensation, except where otherwise prohibited by law

6. SELECTION(S): On or about April 22^nd 2024, eligible purchaser(s) will be selected in a drawing from among all eligible submissions received. Selection(s) will be conducted by Sazerac’s representative or designee, whose decisions shall be final and binding in all respects. Submitters will be contacted by email or other means as determined by Sazerac, and will be asked to provide the necessary information (such as first and last name, email address, mailing address, and/or phone number) to Sazerac. 

7. OPPORTUNITIES TO PURCHASE: There will be a total of one-hundred (100) opportunities to purchase offered. Odds of being selected depend on the number of eligible submissions received. Any selection details not specified above will be determined by Sazerac in its sole discretion. Limit one (1) opportunity to purchase per submitter. If submitter is selected in both drawings, submitter may still only receive one opportunity to purchase in total. In that event, Submitter may, subject to product availability, select either the first or second opportunity to purchase which they were selected for. 

8. CONDITIONS OF PARTICIPATION: Opportunities to purchase are not transferrable. Submitters, including those who receive an opportunity to purchase, may not gift, sell or otherwise transfer their submission or opportunity to purchase to anyone else. Taxes are the sole responsibility of submitter. In the event of an opportunity to purchase no longer being available, no substitutions or replacement opportunity will be offered, except by Sazerac, who may, in its sole discretion, elect to offer a comparable substitute. Sazerac shall not be held responsible for any delays in any component of the process for any reason, in its sole discretion. Sazerac may elect to cancel the Submission in part or in its entirety at any time and for any reason. Entry into this Selection Process constitutes submitter’s agreement to be bound by the terms of these Terms and Conditions and by the decisions of Sazerac, which are final and binding on all matters pertaining to this Selection Process. Submitters may be required to sign and return an Affidavit of Eligibility/Liability & Publicity Release or other documents to verify submitter’s identity within 2 days following the date of first attempted notification, in Sazerac’s sole discretion. Failure to comply within this time period may result in disqualification and selection of an alternate submitter. In the event that any notification message is returned as undeliverable or if no response to the notification message is received within the time period stated or if the submitter is found ineligible or does not comply with these Terms and Conditions, the opportunity to purchase may, in the Sazerac’s sole discretion, be forfeited and given to an alternate submitter from among remaining eligible Submissions. If Sazerac is unable to confirm a submitter after a good faith attempt, the opportunity to purchase may not be awarded in Sazerac’s discretion. If the confirmed submitter forfeits or doesn’t utilize the opportunity to purchase for any reason, no alternate submitters are required to be selected, except by Sazerac in its sole discretion. If, for any reason, more than one (1) notification is sent (or more than one (1) claim is received), Sazerac reserves the right to issue the opportunity to purchase through a drawing from among all eligible Submissions received or via other means. As a condition of entry, submitters agree that (1) the Selection Process is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, or Twitter; and (2) any questions, comments or complaints regarding the Selection Process will be directed to Sazerac, not to Facebook, Instagram, or Twitter. Failure by Sazerac to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. 

9. RELEASE: By participating in the Selection Process, submitter agrees to release Sazerac, Facebook, Instagram, Twitter, and each of their respective parent companies, subsidiaries, affiliates, related companies and advertising, promotion and public relations agencies, Sazerac Company, Inc. Buffalo Trace Distillery, and each of their respective affiliates, officers, directors, employees and agents (“Released Parties”) from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Selection Process or with respect to issuing, receipt, possession, use and/or misuse of any opportunity to purchase. The Released Parties not responsible for any typographical or other error in the printing of the offer, administration of the Selection Process, or in the announcement of same. A submitter may be prohibited from participating in this Selection Process if, in Sazerac’s sole discretion, it reasonably believes that the submitter has attempted to undermine the legitimate operation of this Selection Process by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other submitters, Released Parties, or associated agencies or entities.

10. DISPUTES: Except where prohibited, submitter agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Selection Process or any opportunity to purchase shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the commonwealth of Kentucky. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, submitter’s rights and obligations, or the rights and obligations of the Sazerac in connection with the Selection Process, shall be governed by, and construed in accordance with, the laws of the commonwealth of Kentucky, without giving effect to any choice of law or conflict of law or conflict of law rules (whether of the commonwealth of Kentucky or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the commonwealth of Kentucky.

11. WARRANTY AND INDEMNITY: To the maximum extent permitted by law, each submitter indemnifies and agrees to keep indemnified the Released Parties at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Released Parties may become liable by reason of or related or incidental to any act, default or omission by an submitter under these Terms and Conditions including without limitation resulting from or in relation to any breach, non-observance, act or omission, whether negligent or otherwise, of these Terms and Conditions by a submitter.

12. ELIMINATION: Any false information provided within the context of the Selection Process by any submitter concerning identity, postal address, telephone number, ownership of right or noncompliance with these Terms and Conditions or the like may result in the immediate elimination of the submitter from the Selection Process. Sazerac further reserves the right to disqualify any Submission that it believes in its sole discretion does not comply with these Terms and Conditions.

13. WAIVER: Submitters hereby waive all rights to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket costs; and (ii) have damages multiplied or otherwise increased. 

14. LIMIT OF LIABILITY: Sazerac is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry or Submission information by Sazerac on account of technical problems or traffic congestion via mobile phone or otherwise. If, for any reason, the Selection Process is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, act of God, or any other causes which corrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Selection Process, Sazerac reserves the right at its sole discretion to cancel, terminate, modify or suspend the Selection Process or any portion thereof at any time, and for any reason without further obligation or advance notice. Sazerac reserves the right, but does not have any obligation, to select from eligible Submissions received as of the termination date. Sazerac further reserves the right to disqualify any individual who tampers with the entry process or the operation of the Selection Process or acts in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner. 

15. CAUTION: Any attempt by a submitter to deliberately damage any associated website or undermine the legitimate operation of the Selection Process is a violation of criminal and civil laws and should such an attempt be made, Sazerac reserves the right to seek damages from any such submitter to the fullest extent of the law. 

16. SEVERABILITY: If any provision(s) of these Terms and Conditions are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
